Are You Positive? Legal?

Another curiosity of the English language, American branch, popped up in today's paper. An item explained that defrocked Tour de France winner Floyd Landis had lost his title because of a "positive doping test." Now, I know they are saying he failed a doping test, but wouldn't that make it a negative doping test? I'm pretty positive Landis saw it that way (and still does).
That falls into the same category with reports that someone who isn't Floyd Landis was determined to be "legally drunk" after being tested by police. So, if he/she was legally drunk, why did they arrest him/her? Technically, didn't they determine that said person was illegally drunk and, therefore, entitled to be arrested for DWI or public intox?
Weird language, ours.
